Prices in Westie are submitted by other shoppers and read automatically from photographs. They can be wrong, out of date, or misread. Always check the price in the store before you rely on it. Westie is not affiliated with any grocery retailer.

1. Agreement to these terms
These Terms of Use ("Terms") are a binding agreement between you and Miss Tech ("Westie", "we", "us") governing your use of the Westie mobile app, the westie.fyi website, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
2. Eligibility
You must be at least 13 years old to use Westie (16 if you're in the UK or EEA, or older where your country requires it). If you're under the age of majority where you live, you may only use Westie with the involvement of a parent or guardian. By using the Service you confirm you meet these requirements and that you're not barred from using it under applicable law.
3. Your account
You need an account to contribute prices. You agree to provide accurate information, to keep your login credentials secure, and to be responsible for everything that happens under your account. Tell us promptly at jmfrankl@gmail.com if you believe your account has been compromised. You may close your account at any time — see Deleting your account.
4. What Westie provides
Westie lets you search grocery items, view prices that other users have recorded at nearby stores, and contribute prices yourself by photographing shelf tags, products and receipts. Photos you submit are analysed automatically to extract prices and product details. We may change, suspend or discontinue any part of the Service at any time.
5. Prices are user-contributed — no guarantee of accuracy
This is the most important thing to understand about Westie. Prices, product details, sizes, units and store associations in the Service come from users like you, and are read from photographs using automated analysis that can make mistakes. Consequently:
- Prices may be inaccurate, incomplete, misread or out of date.
- A price may have changed, expired or been a temporary promotion since it was recorded.
- Prices may vary between locations of the same retailer, and may not include taxes, deposits, fees, loyalty discounts or membership pricing.
- A product shown at a store may not be stocked there, or may differ in size or variety.
Westie is provided for informational purposes only. It is not an offer to sell, and it does not create any obligation on any retailer to honour a price shown. Always verify the price in the store before making a purchasing decision. We are not responsible for any loss arising from your reliance on information in the Service.
6. Store names and trademarks
Westie displays the names and locations of grocery retailers so you know where a price was recorded. Westie is not affiliated with, endorsed by, sponsored by, or in any way officially connected to any retailer, store or brand named in the Service.
All product names, brand names, store names, logos and trademarks are the property of their respective owners. They're used in the Service only to identify the retailer or product a price relates to — nominative use for the purpose of accurate description. Their use does not imply any affiliation with or endorsement by their owners. If you own a mark and have concerns about how it appears in the Service, contact us and we'll respond promptly.
7. Your content
"Your Content" means anything you submit to the Service — photographs, prices, product details, notes and any other material. You keep ownership of Your Content.
By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable and transferable licence to host, store, reproduce, adapt, publish, display and distribute it in connection with operating, improving and promoting the Service. This licence lasts as long as the content is in the Service and continues for price records that remain in the shared catalogue after your account closes (in a form no longer associated with you, as described in our Privacy Policy).
You represent and warrant that:
- You have the right to submit Your Content and to grant this licence.
- Your Content doesn't infringe anyone's intellectual property, privacy or other rights.
- Photographs you submit are of shelf tags, products, receipts or similar retail subjects — not of people, and not of anything confidential.
- The prices and details you submit are, to the best of your knowledge, accurate and observed by you.
8. Acceptable use
You agree not to:
- Submit prices you haven't actually observed, or deliberately false, misleading or manipulated pricing information.
- Upload content that is unlawful, infringing, defamatory, harassing, hateful, obscene, sexually explicit, or that depicts or targets any person without their consent.
- Upload photographs containing other people's personal information, payment card details or similar sensitive data.
- Impersonate anyone, or misrepresent your affiliation with any person or organisation.
- Scrape, harvest, bulk-download or systematically extract data from the Service, or use automated means to access it, without our written permission.
- Interfere with, overload, or attempt to gain unauthorised access to the Service or its infrastructure.
- Reverse engineer, decompile or disassemble the app, except where that restriction is prohibited by law.
- Use the Service to build a competing product or dataset, or resell or commercially redistribute its data.
- Use the Service in violation of any applicable law or these Terms.
9. Reporting content
If you see content in Westie that's inaccurate, offensive, infringing or otherwise breaches these Terms, report it to jmfrankl@gmail.com with enough detail for us to find it. We review reports and may remove content or suspend accounts at our discretion. We aim to respond to reports promptly.
10. Copyright complaints
If you believe material in the Service infringes your copyright, send a notice to jmfrankl@gmail.com (Attn: DMCA Agent, Miss Tech, 510 Sherwood Forest Pl, Cary, NC 27519-6353, USA) including: your contact details; identification of the copyrighted work; identification of the material you say is infringing and where it appears; a statement that you have a good faith belief the use isn't authorised; a statement that the information is accurate and, under penalty of perjury, that you're authorised to act; and your physical or electronic signature. We respond to valid notices and may terminate repeat infringers' accounts.
11. Our intellectual property
The Service — including the app, the website, our name, logo, design and the software behind it — is owned by Miss Tech and protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial use. We reserve all rights not expressly granted.
12. Privacy
Our Privacy Policy explains what we collect and how we handle it, and forms part of these Terms. Note in particular that prices and photos you contribute are visible to other users.
13. Suspension and termination
You may stop using Westie and delete your account at any time. We may suspend or terminate your access — with notice where reasonable, and immediately where necessary — if you breach these Terms, if we're required to by law, or if continuing would create risk or liability for us or other users. Sections that by their nature should survive termination (including sections 5, 6, 7, 11, 14, 15, 16 and 17) do survive.
14. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty as to the accuracy, reliability, completeness or timeliness of pricing or product information.
We don't warrant that the Service will be uninterrupted, secure or error-free, or that defects will be corrected. Some jurisdictions don't allow certain disclaimers, so parts of this section may not apply to you.
15. Limitation of liability
To the fullest extent permitted by law, Miss Tech and its owners, officers and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, or for any amounts you spent or failed to save, arising out of or relating to your use of — or inability to use — the Service, whether based in contract, tort, negligence, strict liability or otherwise, even if we've been advised of the possibility.
To the fullest extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or US $50.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence or for fraud. Some jurisdictions don't allow these limitations, so they may not fully apply to you.
16. Indemnification
You agree to indemnify and hold harmless Miss Tech and its owners, officers and contractors from any claims, damages, losses, liabilities and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your breach of these Terms or of any law or third-party right.
17. Governing law and disputes
These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict of laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Wake County, North Carolina, and waive any objection to venue there.
If you're a consumer resident in a jurisdiction whose law grants you the right to bring proceedings in your local courts or to the protection of mandatory local consumer law, nothing here removes that right.
We encourage you to contact us first — most disputes can be resolved informally, and we'll try to do so in good faith.
18. App stores
You obtained the Westie app through an app store, and your use is also subject to that store's terms.
Google Play. Google is not a party to these Terms and has no responsibility for the app or its content, and no obligation to provide support or maintenance for it.
Apple. If you obtained the app from the Apple App Store: these Terms are between you and Miss Tech only, not Apple. Apple has no obligation to provide support or maintenance. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to the app, including product liability, legal or regulatory non-compliance, or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
19. Changes to these terms
We may update these Terms from time to time. We'll change the "Last updated" date above, and for material changes we'll give reasonable notice in the app or by email before they take effect. If you keep using the Service after a change takes effect, you accept the updated Terms. If you don't agree, stop using the Service and delete your account.
20. General
These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest stays in effect and the unenforceable part is limited to the minimum extent necessary. Our failure to enforce a provision isn't a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Nothing in these Terms creates a partnership, agency or employment relationship.
